Correct answer
- CSí, salvo que la ayuda esté ya organizada.Yes, unless help is already organised.
Anyone who witnesses, comes across or is involved in an accident must help when necessary, as long as there is no risk to themselves or others. Failing to do so is the crime of failure to help (omisión de socorro) under the Criminal Code. The same applies to people who cannot help but do not urgently ask others for help. Road users who are NOT involved do not have to do this when the authorities or their officers are already at the scene, or when their help is not needed.
